Bus 508 - Law and Ethics

Course Description:

The course objective is to provide graduate students with practical knowledge of legal issues and principles that often arise in the business environment. Most people are often ill-equipped to identify legal difficulties before they arise and to effectively strategize to avoid problems from occurring or, at least, spiraling out of control. Any business may be subject to various legal concerns ranging from employment law issues, contract disputes, regulatory compliance, environmental investigations, negligence claims, purported violations of fiduciary duties and securities fraud to name a few. Litigation is an inevitable cost of doing business, although it is controllable. Acquiring hands on knowledge will prove to be invaluable to you. Having the ability to spot potential legal problems and minimize their risk to your business will enhance your credibility and increase your effectiveness.

Student Learning Outcomes:

Read business cases and legal cases and describe orally and writing the issues of the cases (1,5).
Describe in writing alternative ethical frameworks and their implications for managers (1,5).
Demonstrate in writing and understanding of the inter-relationships among the disciplines within business economics (1,3,4,5).

In addition to fulfilling the course objectives, each assignment and activity is specifically created to facilitate understanding of basic legal concepts and issues facing business owners, employers and employees. Most importantly, these assignments and activities are used to develop their critical thinking and legal analysis skills and be able to apply those skills immediately whether on the job or if they decide to continue onto law school.

Comparing and Contrasting Intellectual Property Rights: Creating a IP Chart

The majority of creations, products, or inventions contain more than one intellectual property right. Sometimes, an individual or business will choose which property right or rights best protect their creation.

For example: the iPhone, how many rights do you think are contained in one iPhone? Consider how many patents and/or copyrights are in the hardware, software, applications? Are all of them owned by Apple? What about the design of the phone, the functions, colors, etc. Does Apple or the iPhone have a trademark? Are there any trade secrets involved with this product?

Before you can determine which of the four major intellectual property right(s) are best for your creation you have to be able to compare and contrast these rights.

iPhone 6 plus

This assignment is to develop your knowledge of these major rights.

You will create a chart or summary that discusses the four main types of intellectual property rights. List the specific types of original works that are covered under copyright, patent, trademark and trade secret. Distinguish between how each right is created, how long each property right lasts, and how each are infringed. Students will choose between CI Docs, Adobe Spark or other self-supported media option. No additional materials are needed to successfully complete the assignment beyond the required course materials and those provided by the professor.

Students will complete the assigned content in the Intellectual Property module.
Select the media option you will use to create your interactive summary or chart regarding patent, copyright, trademark and trade secret.
Create a separate section for each intellectual property right.
For each separate section you must include the following information: how is the property created? does it need to be registered, etc.? , what types of creations, or works are covered under this right?, how long does the property right last? does it expire?, how are these rights infringed or stolen? Are there defenses?
The information presented must be succinct and concise and should include examples of protected works.
You have a choice of format but the final version must be submitted with a link.
Students are required to view and analyze at least two peer projects and write a reply that includes how the presentation was different from your own.
Students are also required to review the feedback from their fellow students and incorporate any relevant feedback into their assignment before submitting it to the instructor.
The instructor will also post feedback and comments on the discussion board but will not respond to every comment.
